As the AYPERİ EKİNCİ sole proprietorship brand THE RUF, we would like to inform and enlighten you regarding personal data processing, transfer of your processed personal data, collection methods of your personal data and your other rights listed in Article 11 of the KVKK, in accordance with Article 10 of the Law on the Protection of Personal Data No. 6698 (“KVKK”). We would like to state that we show utmost sensitivity regarding the confidentiality and security of all personal data you provide to us and that all necessary technical and administrative security measures have been taken for the protection of this data.

DATA CONTROLLER AND REPRESENTATIVE

As THE RUF, as the data controller, we may process, record, store, classify, update your personal data in accordance with the law and rules of integrity, within the scope of the purposes explained below, and may disclose/transfer them to third parties in cases permitted by legislation and/or limited to the purpose for which they are processed.

YOUR PERSONAL DATA PROCESSED

Within the scope of your use of our company's products and services, the following personal data is processed:

  • Identity information (name, surname, Turkish identity card)
  • Contact Information (address, mobile phone, e-mail)
  • Shopping Information (shopping date, time, amount, content, payment method, invoice information, etc.)
  • Your Financial Information (bank account information / credit card information)
  • Other personal data that you personally provide within the framework of your requests, suggestions and complaints,
  • If you use our websites, we collect information about your behavior and activities through cookies.

PURPOSE OF PROCESSING PERSONAL DATA

Your personal data is processed in accordance with the basic principles set out in the KVKK and relevant legislation, in order for you to benefit from the services we offer as THE RUF, based on your explicit consent and/or other cases stipulated in Article 5/2 of the KVKK, primarily the legal legislation we are subject to. THE RUF's purposes for processing personal data are;

  • Sending your orders to the address you have provided, carrying out the purchasing of goods, sales processes and after-sales support services in general, in relation to fulfilling our obligation to perform the obligation arising from the contract,
  • If you permit, to plan and carry out personalized sales and marketing activities, to carry out promotions and campaigns, and to inform you about campaigns carried out in our company,
  • Sending mail to users who subscribe to the newsletter via the website from which the service is received,
  • Evaluation of requests and complaints,
  • Customer acquisition and sending newsletters if you give permission,
  • Carrying out the planning and statistical activities required by our company,
  • Determining and implementing our company's commercial and business strategies,
  • Keeping accounting records,
  • Carrying out our finance, communication, market research and purchasing operations,
  • It will be processed in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698 in order to provide you with better and more reliable service.

METHOD OF COLLECTING PERSONAL DATA AND LEGAL REASON

Your Personal Data is collected electronically through our website through transactions you have made online (membership, newsletter subscription, etc.).

We process your personal data, which we collect in accordance with the above methods, based on one or more of the following legal reasons:

  • Your explicit consent (for advertising/promotion/marketing activities, commercial communication activities and domestic/international data transfer)
  • If the provisions of the laws and regulations in force in the Republic of Turkey make processing necessary (Your data can be processed if the relevant legislation, especially the Code of Obligations, Commercial Code, Consumer Law, Law No. 5651 on the Regulation of Publications Made on the Internet and Combating Crimes Committed through Such Publications, Law No. 6563 on the Regulation of Electronic Commerce, makes data processing necessary and mandatory.)
  • Because it is necessary to process personal data of the parties to a contract, provided that it is directly related to the establishment or performance of a contract (The establishment of a membership contract constitutes a legal basis for personal data processing activities necessary for the establishment or performance of a contract, such as completing online sales transactions with your membership information.)
  • Because it is mandatory for the fulfillment of a legal obligation (Secondary legislation constitutes a legal reason for data processing purposes such as fulfilling requests in accordance with the legislation within the scope of regulatory and supervisory activities, alternative dispute resolution methods and conducting and concluding litigation processes, and making requests from the courts.)
  • Based on the legal grounds of THE RUF's legitimate interest, so that THE RUF can carry out its activities and provide the products in question and provided that it does not harm the fundamental rights and freedoms of data owners,

Personal data may be processed in accordance with the personal data processing conditions specified in Articles 5 and 6 of Law No. 6698.

PARTIES TO WHICH PROCESSED PERSONAL DATA IS TRANSFERRED AND THE PURPOSE OF TRANSFER

Your Personal Data is processed by our company in accordance with the law and the rules of honesty, in an accurate and up-to-date manner when necessary, for specific, clear and legitimate purposes, in connection with the purpose for which it is processed, limited and proportionate, and in accordance with the principles of retention for the period stipulated in the relevant legislation or necessary for the purpose for which it is processed.

Your personal data may be transferred to the following parties, limited to the purposes listed in this notification, provided that the conditions set forth in Articles 8 and 9 of the KVKK are complied with and the necessary security measures are taken:

  • The processed Member Customer/Guest Customer data and the person information for whom the purchased product will be delivered are shared with the cargo company. The person information for whom the invoice will be issued is shared with the cargo company for the purpose of sending the invoice to the relevant person.
  • The mobile phone number and/or e-mail address of the Member Customer/Guest Customer may be shared with the commercial electronic message service provider for the purpose of making promotions, advertising, offering benefits and opportunities in line with shopping preferences, tastes and habits, based on the approval of the commercial electronic message.
  • It is shared with the marketing automation platform from which the service is received for users who subscribe to the newsletter.
  • Website application usage preferences and navigation history may be shared with our domestic/international business partners from whom we receive cookie services or newsletter subscription services, for the purpose of segmentation and communicating with Member Customers/Guest Customers in line with their tastes and preferences.
  • It may be shared with domestic/overseas/public/private institutions and organizations, suppliers and other third parties or organizations from which our company receives service/support/consulting or cooperates.
  • Our company's affiliates, consultants, shareholders or solution partners
    may be shared with group companies.
  • It may be shared with our service providers, who process personal data on behalf of our company, in the country and/or abroad, from whom we receive support in the areas of storage, archiving, information technology support (server, hosting, software, cloud computing, etc.), etc.

RIGHTS OF THE PERSON WHOSE PERSONAL DATA IS PROCESSED

We hereby inform you that, as a personal data owner, you have the following rights pursuant to Article 11 of the Law:

  • Learning whether personal data is being processed,
  • To request information regarding the processing of personal data,
  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • To know the third parties to whom personal data is transferred, either domestically or abroad,
  • To request correction of personal data if it is processed incompletely or incorrectly,
  • Requesting the deletion or destruction of personal data,
  • To request that third parties to whom personal data has been transferred be notified of the correction, deletion or destruction of personal data,
  • To object to a result that is to the detriment of the person himself/herself, as a result of the analysis of the processed data exclusively through automatic systems,
  • To request compensation in case of damages due to unlawful processing of personal data.

The personal data we collect and process must be accurate and, if necessary, up-to-date, in accordance with Article 4 of the Personal Data Processing Law No. 6698. Therefore, if there is any change in your personal data, you can provide your up-to-date and accurate personal information through the methods specified below.
